Theme:

How African Americans are Disadvantaged in Our Justice System and by Other Institutions and what Should be done About it.

For this discussion, I choose a documentary, “13th about the American Criminal Justice System.” The film demonstrates historical injustices which were based on the prejudice and stereotypes .  Of African American people .  The crimes against black people were perpetrated by the government and installed justice system that perpetuated stereotypical and racist laws and policies.

The pollical and legal system in United States promoted segregation and labeled black people as invaders .  Who are like animals and therefore should not co-exist with the white. The policies and laws were further engraved in the mind of white Americans  . And propagated by media and hence incited violation against the rights of black people in all realm of Americans life.

As a result, black people were brutally murdered, raped and incarcerated without justice for them.

The psychology of courtroom decisions has revealed that personal backgrounds ,  Unconscious biases about race, gender, and appearance and even the time of day , Play a more critical role in outcomes than the actual law. A book by Adam Benforado, a professor of law at Drexel University ,  In his book “Unfair: The New Science of Criminal Injustice” expose the unsettling problems with the justice system in America.

The book reveals the illogical and unfair manners in which judges, jurors, attorneys ,  And others in the legal system make decisions on who walks free and who is sent to prison. According to him, the injustices are as a result of both psychological and neurological problems ,  And assumptions firmly cemented over centuries. Therefore, both the race of the victim and of the defendant influenced sentencing.

It has been found that the defendants with more stereotypical “black features” were more likely to be sentenced to death or imprisoned.

What needs to be done?

Justice system needs both structural and psychological transformations to end this perennial systemic problem. Some of the actions that can be taken include:

  1. Carry out reforms on police and other justice enforcing bodies or entities.

  2. Have oversight on police conduct with stringent measures for justice contraventions.

  3. Do away with jurors and have judges only in a trial. The move will make judge responsible for their ruling and sentencing.

  4. Or there should be a change in how jurors are asked to do their job.
